The annual tax laws amendment legislation results in a number of changes to the tax laws that will affect taxpayers going forward. Some of these changes are fundamental changes that may affect the way transactions are generally structured while others deal with smaller technical matters. Irrespective of the category in which the amendment falls, these amendments have a significant impact on all those affected by it. The aim of this session is to provide a detailed discussion of a selection of amendments that are likely to be of interest to tax practitioners and taxpayers in general.


In addition, the body of knowledge in taxation is continuously formed and updated as new cases are decided in the courts. New rulings issued by SARS provide a good indication of the SARS view on certain matters, despite these rulings being fact specific and only binding towards the applicants. The session will also consider some of the most important developments during the year in this regard.


Course Content

This annual update will cover the following topics:

  • Taxation laws and Tax Administration laws amendments bills for 2016 which are likely to include amendments affecting:

    • Structures to transfer assets into trusts (proposed section 7C)

    • Share incentive schemes

    • Hybrid funding instruments

    • Refinements to the retirement tax reforms

    • Tax administration amendments

  • Important developments in the field of tax over the past year (case law and rulings)  

Pieter van der Zwan

Pieter is an associate professor at the North-West University (NWU) where he is the leader of the Taxation Program. He teaches taxation to honours chartered accountancy and master’s degree students. He received the award as the best lecturer on the NWU's Potchefstroom Campus in 2011.

He is a qualified Chartered Accountant. He completed his articles at KPMG and spend time in KPMG's technical department after completing his articles. Since joining the NWU, Pieter has been involved in private practice as a technical advisor to audit firms and companies on tax and IFRS matters. In addition, he has also presented numerous tax and IFRS seminars and workshops to auditors, accountants and finance divisions of companies over the past 4 years.

Pieter has published a number of articles in accredited academic journals and also makes regular contributions to tax and accountancy magazines (including TaxTalk).

Herman van Dyk CA(SA), ACA (England and Wales), MCom (SA & International Tax)

Herman van Dyk is the Programme Leader for Taxation at the Potchefstroom Campus of the North-West University. He is a Chartered Accountant (SA) and Associate Chartered Accountant (England & Wales). He graduated with an MCom in South African and International Taxation cum laude. He received an academic award for the research part of this qualification titled Grounds for allowing a tax deduction for employee share incentives (best dissertation in the class). In 2012 he received the Rapport Top Lecturer Award for inspirational teaching and academic leadership in the Faculty of Economic and Management Sciences. In 2014, he received an Institutional Teaching Excellence Award. Herman has contributed to several accredited South African and international journals.

Payments & Cancellations

Section 240A of the Tax Administration Act, 2011 (as amended) requires that all tax practitioners register with a recognized controlling body before 1 July 2013. It is a criminal offense to not register with both a recognized controlling body and SARS.
