SARS published the draft public notices in respect of automatic exchange of financial account information (sections 26, 29 and 30) for comments not later than Friday 6 June 2014.

During 2013, National Treasury and SARS announced the start of negotiations with the United States of America's Treasury (US Treasury) to enter into an intergovernmental agreement (IGA) with respect to the USA's Foreign Account Tax Compliance Act (FATCA). SARS issued a media release in this regard on 3 April 2014.

Please click here to view the draft public notice in terms of sections 29 and 30 - Keeping of books, records, accounts of documents and form in which these should be kept.

The draft public notice in terms of sections 29 and 30 should be read with the draft Business Requirements Specifications (BRS) Version 1.0.0 from SARS Operations. Note the different date and address for comments for the operational document.

The SAIT will be making submissions to SARS on this matter.  Kindly submit all comments to taxassist@thesait.org.za by no later than Wednesday 4 June 2014.

WHY REGISTER WITH SAIT?

Section 240A of the Tax Administration Act, 2011 (as amended) requires that all tax practitioners register with a recognized controlling body before 1 July 2013. It is a criminal offense to not register with both a recognized controlling body and SARS.
